By accessing the CaskCartel.com Premium Spirits Marketplace which shall be further known as the “Marketplace” The user, who shall be further known as the “Party” agrees that All SALES ARE FINAL. Once an order has been received/confirmed/paid there is a NO REFUND POLICY. Orders are accepted by licensed retailers and once items have been ordered the fulfillment process begins and are unable to be stopped or cancelled. By utilizing the “Marketplace” you as the “Party” understands that the guaranteed time to ship products are subject to 30-days from the date an order is processed. If the licensed retailer fails to fulfill and ship your order within 30-days your entitled to a full refund. Excluded from this 30-day order shipping time frame are the transit times by the courier. Items/Products fulfilled by overseas retailers/vendors the shipping transit times are increased and are subject to customs clearance which can also delay and extend delivery of a particular item or order. Please contact the support team if you have questions on specific items inventory status prior to placing an order or if you have concerns with shipping/transit time frames. Some overseas items will ultimately have extended transit times even though they are shipped within the guaranteed 30-day shipping period. The transit times and customs clearance delays are out of the control of the “Marketplace”, and the "Party" agrees to a hold harmless policy. Only if the retailer fails to fulfill and ship your order within 30-days does it qualify for cancellation/refund. In the unusual event you receive a damaged or wrong item(s) you as the “Party” agrees to give the “Marketplace” the opportunity to replace the item(s) before a refund or credit shall be issued. You must contact us for replacement within 5-days of receipt of delivery. After 5-days of delivery receipt it subject to the “Marketplace” and its discretion on how to handle the issue and maybe ineligible for return or replacement. Its further advised that the "Party" documents with photographs to assist in a speedy replacement process. Additionally, the fulfillment retailer may require the return of unopened/damaged product so please do not throw out any packaging or product unless instructed by the “Marketplace”.
The “Party” agrees that if for any reason an order that has been attempted delivered and then returned or declined by the “Party” this includes orders that are a failed delivery attempt as a result of the adult signature requirement or not collected from a carrier’s access point will not qualify for refund as the "Marketplace" has fulfilled its obligation under the contract agreement terms of service. "Party" will be responsible for original shipping and return shipping charges along with any re-delivery and storage fees. "Marketplace" will make reasonable attempts to resolve any issue as it relates to delivery however the policy is to hold products for 30-days before they will be disposed of.
*PREORDERS* Do not have a guaranteed ship date. This is an exception to the policy/agreement. Since the exact time or date that the product will arrive to be dispatched out to you is unknown. All preordered items come directly from the distillery to a distribution warehouse then finally to the local licensed retailer who fulfills the order. PREORDERS are NOT subject to the 30-day fail to fulfill or ship policy. The “Party” agrees that there is no guaranteed delivery timeline for preorders and waive all rights to a credit card dispute or chargeback in such instance.
Producers and Brands may update their bottle design, packaging, and artwork at any time. For this reason, you may receive a product labeling or packaging that is different than pictured. “Please refer to the disclaimer below each product image” If you want to ensure that you will receive the product image shown, you must verify this with our support team prior to purchase. If you receive the “same” product however labeling differs from what is pictured on the marketplace, the “Party” agrees that it will not be eligible for return or replacement and waives its rights to a credit card dispute.
Credit Card disputes and bank fraud are taken serious at CaskCartel.com and the “Marketplace” intends on working with law enforcement to prosecute internet fraud. The “Party” agrees that it waives all rights to disputes or chargebacks unless the “Marketplace” is in violation of the policies/agreement set forth herein. The “Party” hereby authorizes its financial institution to close any dispute made by the “Party” in favor of the “Marketplace” without prejudice as long as the “Marketplace has satisfied or is in a continuation process of satisfying its part of the agreement within the guaranteed fulfillment time frame.
This agreement between the "Marketplace" and "Party" shall be duly executed on the date and time that the "Party" agrees & accepts the terms of this agreement during the checkout whereas and the transaction is successfully processed by a payment gateway issuing an "Authorization Key" For any additional questions relative to this policy or concerns please reach out to help@caskcartel.com
