The CaskCartel.com Premium Spirits Marketplace (the "Marketplace") is committed to utilizing a preferred network of licensed retailers to fulfill all orders. Fulfillment is processed through a third-party shipping and logistics provider. Typical order processing time is within one (1) to four (4) business days; however, such processing time is not guaranteed.
By accessing and purchasing through the "Marketplace," the user (the "Party") expressly acknowledges and agrees that ALL SALES ARE FINAL. Once an order is received, confirmed, and paid, a strict NO REFUND POLICY applies. Orders are accepted by licensed retailers, and once submitted, the fulfillment process begins and cannot be cancelled or stopped.
The "Party" understands and agrees that licensed retailers are afforded up to thirty (30) days from the date of order processing to fulfill and ship products. If a licensed retailer fails to fulfill and ship the order within such thirty (30) day period, the "Party" shall be entitled to a full refund.
This thirty (30) day guarantee applies solely to fulfillment and shipment obligations of licensed retailers and does not extend shipping transit times by carriers or customs authorities. Orders fulfilled by retailers outside your home country or vendors are subject to extended transit times and potential customs clearance delays, which are expressly outside the control of the "Marketplace." The "Party" agrees to hold the "Marketplace" harmless for any such delays.
In the event an incorrect or damaged product is received, the "Party" must notify the "Marketplace" within five (5) days of delivery and shall provide photographic documentation of the issue. The "Marketplace" shall be afforded the opportunity to replace the item(s) prior to issuing any refund or credit. Failure to provide timely notice within five (5) days of delivery may render the "Party" ineligible for return, replacement, or refund, at the sole discretion of the "Marketplace."
The "Marketplace" and/or its fulfillment partners may also require the return of unopened and/or damaged products. Accordingly, the "Party" is advised not to discard any product or packaging unless expressly instructed by the "Marketplace."
All orders tendered for delivery, as evidenced by carrier tracking to the shipping address provided by the purchasing "Party", and subsequently returned, refused, or otherwise not accepted by the "Party"—including, without limitation, where delivery fails due to the absence of an adult signature or remains unclaimed within the carrier’s prescribed time frame (including retention at carrier access points following notice of attempted delivery)—shall be deemed fully delivered and fulfilled by the "Marketplace". Such orders are final and ineligible for refund.
In limited circumstances, and at the sole discretion of the "Marketplace", returns may be accepted. In such cases, the "Party" shall be responsible for a restocking fee equal to thirty-five percent (35%) of the purchase price, as well as all original shipping charges and any return shipping costs incurred.
All transactions made through this website are governed both by the "Party’s" cardholder member or user agreement with the issuing bank and by these Terms and Conditions. By completing a purchase, the "Party" expressly acknowledges and agrees that the "Marketplace’s" fulfillment obligations are strictly limited to those set forth herein, including, but not limited to, the "Party’s" sole responsibility for all customs clearance duties, taxes, and related charges.
In the event of any dispute, the "Party’s" rights and remedies under the applicable cardmember agreement shall be construed in accordance with, and subject to, these Terms and Conditions. Any shipment refused, abandoned, returned, or otherwise disposed of due to the "Party’s" failure or refusal to pay duties, taxes, or related charges shall be deemed properly fulfilled and shall not give rise to any right of chargeback, reversal, refund, or credit card dispute.
If a dispute or chargeback is initiated for any reason other than the “Marketplace” has failed its fulfillment obligation, the "Party" acknowledges and agrees that these Terms constitute a binding legal obligation for goods duly rendered. Regardless of the outcome of such dispute or chargeback, the "Party" shall remain fully responsible for all amounts owed.
The "Marketplace" reserves the right to pursue collection of any outstanding debt by all lawful means available. The "Party" shall be liable for, and agrees to reimburse, all costs of collection, including but not limited to reasonable attorneys’ fees, court costs, filing fees, and any other expenses incurred in enforcing the "Marketplace’s" rights.
Preorders do not carry a guaranteed ship or delivery date and shall be deemed an express exception to any other fulfillment policies or agreements. The exact time or date upon which the preordered product will arrive for dispatch is unknown and subject to factors outside the control of the "Marketplace".
All preordered items are shipped directly from the originating distillery to a distribution warehouse, and thereafter to the local licensed retailer responsible for final fulfillment. Accordingly, preorders are expressly excluded from the thirty (30) day fulfillment or shipment requirement set forth in these Terms and Conditions.
By placing a preorder, the "Party" expressly acknowledges and agrees that no guaranteed delivery timeline shall apply to such orders, and further waives any and all rights to initiate, assert, or pursue a credit card dispute, chargeback, or reversal on the basis of delayed delivery or non-shipment within any prescribed period.
Producers and brands reserve the right to update, modify, or alter bottle design, packaging, labeling, and artwork at any time without prior notice. As a result, the "Party" acknowledges and agrees that the product received may feature labeling, packaging, or artwork that differs from the product images displayed on the "Marketplace." Please refer to the disclaimer located beneath each product image.
If the "Party" wishes to ensure receipt of the exact product image displayed, such verification must be requested and confirmed in writing with the "Marketplace" support team prior to purchase.
In the event the "Party" receives the same product, but with labeling, packaging, or artwork that differs from the images shown on the "Marketplace," the "Party" expressly agrees that such variance shall not constitute grounds for return, replacement, refund, or credit card dispute.
Credit card disputes and fraudulent activity are treated with the utmost seriousness by CaskCartel.com (the "Marketplace"). The "Marketplace" expressly reserves the right to cooperate fully with law enforcement authorities in the investigation and prosecution of internet fraud and related offenses, including, without limitation, instances involving high-value items.
The "Party" expressly agrees and acknowledges that it waives any and all rights to initiate, assert, or pursue a credit card dispute or chargeback unless the "Marketplace" is in material breach of the policies or agreement set forth herein.
Furthermore, the "Party" hereby authorizes its issuing financial institution to resolve any dispute initiated by the "Party" in favor of the "Marketplace", without prejudice, provided that the "Marketplace" has satisfied its fulfillment obligations within these prescribed Terms and Conditions.
This Agreement between the "Marketplace" and the "Party" shall be deemed duly executed and binding as of the date and time on which the "Party" accepts and agrees to these Terms and Conditions during the checkout process, and the transaction is successfully authorized and processed by the designated payment gateway, thereby issuing an "Authorization Key."
